Chapter 9 - THE HEARING WITHOUT HIM

Judge Evelyn Porter sat behind a wooden bench forty miles away while Ethan remained locked inside Graystone.

Dana Brooks stood before her holding the flash drive.

The prosecutor, Assistant District Attorney Mark Sloan, looked furious.

“This is highly irregular.”

Dana turned.

“What’s irregular is a man spending three years in prison while evidence proving his story sat in a box.”

“We don’t know when this footage was discovered.”

“We know when it was recorded.”

“That doesn’t establish authenticity.”

Dana held up the drive.

“Then authenticate it.”

Judge Porter raised a hand.

“That will be enough.”

The courtroom went silent.

Claire sat in the back with Rosie asleep against her chest.

She hated courtrooms.

The smell.

The silence.

The way everybody spoke calmly while deciding whether families stayed together or broke apart.

Judge Porter looked at Sloan.

“Did your office possess this footage at the time of trial?”

“No, Your Honor.”

Dana opened a folder.

“Then perhaps the state can explain this.”

She handed a document to the clerk.

The judge read it.

Her face changed.

“What is this?”

“A police evidence intake sheet dated six days after Marcus Reed’s death.”

Dana turned toward Sloan.

“Item forty-seven. Digital security recording. Fulton Hardware.”

Claire’s breath caught.

The state had the video.

From the beginning.

Sloan stood.

“I have never seen that document.”

“I believe you,” Dana said.

He looked surprised.

Dana continued.

“Because according to the signature at the bottom, Detective Daniel Harris checked the recording out of evidence two days before Ethan Cole’s trial.”

A murmur moved through the room.

Judge Porter’s voice sharpened.

“And returned it when?”

Dana looked directly at her.

“He didn’t.”

Claire covered her mouth.

Judge Porter removed her glasses.

“Where is Detective Harris?”

A county attorney stood.

“Your Honor, Mr. Harris retired last year.”

“Where is he now?”

“We are trying to locate him.”

Judge Porter looked furious.

“Try harder.”

Dana approached the bench.

“Your Honor, we also have a recorded phone call in which the state’s primary witness, Ray Damon, admits Marcus Reed was sent to intimidate Mr. Cole.”

Sloan objected.

The judge overruled.

Dana played it.

Ray’s voice filled the courtroom.

Marcus was only supposed to scare him.

Claire cried silently.

Rosie slept through all of it.

Judge Porter stared at the evidence for a long time.

Then she looked toward the empty defense table.

“Where is Mr. Cole?”

Dana’s jaw tightened.

“Graystone is currently under lockdown.”

“Can they produce him by video?”

“They claim technical difficulties.”

Judge Porter looked at Sloan.

“Convenient.”

Sloan said nothing.

The judge leaned back.

“I am prepared to vacate the conviction pending—”

The courtroom doors burst open.

A detective rushed inside.

He whispered to the county attorney.

The attorney turned pale.

Judge Porter frowned.

“What happened?”

The attorney stood.

“Your Honor, we have located former Detective Harris.”

Dana turned.

“Where?”

The attorney swallowed.

“In his vehicle.”

Judge Porter waited.

The next words changed the room.

“He’s dead.”

Claire’s hand flew to her mouth.

Then the attorney added:

“And police found a note beside him.”

“What note?” Dana asked.

May you like

The attorney looked directly at Claire.

“A note that says Ethan Cole knows everything.”
